1) Scope of Application
1.1
These General Terms and Conditions (hereinafter “GTC”) of Tejaswi Appalarowthu, trading under “SiLQ Blumme” (hereinafter “Seller”), apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller regarding the goods presented in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.
1.2
These GTC shall apply accordingly to contracts for the delivery of vouchers, unless otherwise agreed.
1.3
A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1.4
An entrepreneur within the meaning of these GTC is any natural or legal person or legally capable partnership acting in the exercise of its commercial or independent professional activity.
2) Conclusion of Contract
2.1
The product descriptions in the Seller’s online shop do not constitute binding offers but merely serve to invite the Customer to submit a binding offer.
2.2
The Customer submits a binding offer by placing goods in the shopping cart and completing the electronic checkout process by clicking the final order button.
2.3
The Seller may accept the Customer’s offer within five (5) days by:
- Sending an order confirmation in writing or text form (email/fax),
- Delivering the ordered goods, or
- Requesting payment after the order is placed.
If several alternatives apply, the contract is concluded when the first of these occurs. If no acceptance occurs within five days, the offer is deemed rejected.
2.4 PayPal Payments
Payments via PayPal are processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under PayPal’s terms. If PayPal is selected, the Seller accepts the offer upon completion of the payment process.
2.5
The contract text is stored by the Seller and sent to the Customer after order placement. If the Customer has a user account, order details can be accessed there.
2.6
Customers may correct input errors until clicking the final order button.
2.7
Multiple contract languages are available and shown in the online shop.
2.8
Order processing and communication usually take place by email. The Customer must ensure their email address is correct and that emails can be received.
3) Right of Withdrawal
3.1
Consumers are generally entitled to a right of withdrawal.
3.2
Further details are provided in the Seller’s withdrawal policy.
4) Prices and Payment Conditions
4.1
All prices are total prices. No VAT is charged due to small business regulation (§19 UStG).
Shipping costs are stated separately where applicable.
4.2
Available payment methods are displayed in the online shop.
4.3 PayPal Installment & Invoice Payments
PayPal may conduct a credit check. In case of a negative result, payment options may be denied.
4.4 Shopify Payments
Payments are processed via Stripe Payments Europe Ltd., Dublin, Ireland.
4.5 Stripe
Stripe may use additional payment services where applicable.
4.6 Credit Card via Stripe
Payment is due immediately upon contract conclusion. Stripe may conduct a credit check.
5) Delivery & Shipping Conditions
5.1
Delivery is made to the address provided by the Customer.
5.2
If delivery fails due to the Customer’s fault, the Customer bears the resulting costs.
5.3 Transfer of Risk
For entrepreneurs, risk passes upon handover to the carrier.
For consumers, risk transfers upon receipt, unless the consumer selected the carrier independently.
5.4
The Seller may withdraw from the contract if self-supply fails through no fault of its own.
5.5
Self-collection is not possible.
5.6 Vouchers
Vouchers are delivered by email.
6) Retention of Title
Goods remain the property of the Seller until full payment is received.
7) Warranty (Defects Liability)
7.1 For Entrepreneurs
- Seller chooses the method of remedy
- Limitation period for defects in new goods: 1 year
- No warranty for used goods
- Replacement does not restart limitation period
7.2 Exceptions
These limitations do not apply to:
- Intent or gross negligence
- Personal injury
- Fraudulent concealment
- Construction-related defects
- Digital product update obligations
7.3
Legal recourse claims remain unaffected.
7.4
Merchants must inspect goods and report defects under commercial law (§377 HGB).
7.5
Consumers are requested to report transport damage but this does not affect legal rights.
8) Liability
8.1 Unlimited Liability Applies For:
- Intent and gross negligence
- Injury to life, body, or health
- Guarantees
- Mandatory product liability
8.2 Limited Liability
For negligent breach of essential obligations, liability is limited to foreseeable damages.
8.3
Any further liability is excluded.
8.4
These rules also apply to legal representatives and agents.
9) Special Conditions for Custom Goods
9.1
Customers must provide lawful content and rights for personalized goods.
9.2
Customers indemnify the Seller from third-party claims.
9.3
The Seller may refuse illegal or offensive content.
10) Redemption of Promotional Vouchers
- Valid only during promotional period
- Only for consumers
- One voucher per order
- No cash payout
- Not refunded upon return
- Transferable unless fraud is known
11) Redemption of Gift Vouchers
- Redeemable only in the online shop
- Valid until end of 3rd year after purchase
- One per order
- No cash payout
- Transferable
12) Applicable Law
German law applies, excluding UN sales law. Consumer protection laws remain unaffected.
13) Alternative Dispute Resolution
The Seller is neither willing nor obliged to participate in dispute resolution before a consumer arbitration board.
